The European Commission Wednesday said the Bank of Italy did not appear to discriminate against foreign banks in its treatment of bids to take over two Italian institutions

In this case we should stop worrying about EU anti discrimination laws. After all if the burden of proof they need includes a smoking gun and a signed confession, they must be totally toothless.
