Tax Independence?

Germany to change tax on cigarettes

Imperial Tobacco Group PLC and British American Tobacco PLC expressed frustration with a widely-expected decision by the European Court of Justice to force Germany to raise the duty levied on a type of cigarette virtually unique to the country.
Nice to see it demonstrated that there are some areas of taxation where we do not have independence. Whats worse is the reason for the decision.
In July, the European Commission's Advocate General advised Germany be forced to close the loop hole. The European Court of Justice follows that advice in most cases.
Nothing like an independent judiciary is there?
